By completing the purchase, you, the purchaser ("the Purchaser," "you," "Parent," "Guardian"), agree to be bound by the following Official Rules & Terms ("Terms") on behalf of yourself and/or the minor pass holder. This document forms a binding agreement between you and Kong Climbing. Please read it carefully.
1.1 The Pledge: This is not a standard membership purchase. It is a "Commitment Pledge." You are placing a refundable deposit of $999.00 CAD as a wager on your commitment to climbing. In return for this pledge, the designated Pass Holder receives a Kong Exclusive Pass.
1.2 Eligibility for Purchaser: The Purchaser must be 18 years of age or older.
1.3 Eligibility for Pass Holder (the Climber):
1.4 The Pass: The Kong Exclusive Pass grants the designated Pass Holder unlimited climbing access to the Kong Climbing facility for 365 consecutive days from the date of purchase and enrolls them in The Kong Launch Challenge ("the Challenge").
2.1 Challenge Period: The Challenge begins on the date of pass purchase and ends at 11:59 PM on the 365th day following the date of purchase.
2.2 Definition of a Valid Check-in:
3.1 Reward Determination Date: The determination of the Pass Holder's eligibility for a reward will occur only at the conclusion of their 365-day Challenge Period. No early redemptions are permitted.
3.2 Condition for Cash-Back Option: If, at the conclusion of the Challenge Period, the Pass Holder has accumulated Ninety-nine (99) or more Valid Check-ins, the Purchaser is deemed to have successfully completed the Challenge.
3.3 Condition for Automatic Gym Credit: If, at the conclusion of the Challenge Period, the Pass Holder has accumulated fewer than Ninety-nine (99) Valid Check-ins, the Purchaser is deemed to have not completed the Challenge. In this event, the $999 CAD pledge will be automatically converted into a $999 CAD Gym Credit on the member's account.
3.4 Reward Options for Successful Completion: For those who succeed, the Purchaser earns the right to choose ONE (1) of two rewards:
3.5 Redemption Period: Following the end of the Challenge Period, successful Purchasers will have a thirty (30) day "Redemption Period" to submit a "Challenge Completion Form" and declare their reward choice. If no choice is made within this 30-day period, the reward will automatically default to Gym Credit.
3.6 Payment of Cash-Back Reward: For valid cash-back requests, the commencement of payments will begin within 30 business days after the Redemption Period has ended. The disbursement may be made as a single lump-sum payment or in multiple installments (e.g., monthly, quarterly), at the sole discretion of Kong Climbing.
3.7 Purchaser Responsibility & Unclaimed Rewards: The Purchaser is solely responsible for maintaining up-to-date contact and payment information. If Kong Climbing is unable to process a cash-back payment due to invalid information or an unresponsive Purchaser after reasonable attempts at contact over a sixty (60) day period, the cash-back reward will be considered forfeited and will automatically convert to a $999.00 CAD Gym Credit.
4.1 Membership Pause: The 365-day Challenge Period is continuous. However, Kong Climbing may, at its sole discretion, grant a one-time suspension of the membership and Challenge clock for a maximum of ninety (90) days for a documented medical reason or relocation. A formal request with supporting documentation is required.
4.2 Facility Closure: In the event Kong Climbing must close for more than three (3) consecutive days due to unforeseen circumstances, the Challenge Period for all active Pass Holders will be automatically extended by the number of full days the facility was closed.
Gym Credit is non-transferable, non-refundable, and has no cash value. It can be used for Permitted Uses only: All Climbing Courses & Workshops; Future Memberships; Guest Passes; Youth Programs.
It CANNOT be used for Prohibited Uses: Any physical retail goods (gear, apparel), food & beverage, or rental services.
Participation in the Challenge is contingent upon the Pass Holder remaining a member in good standing. KONG Climbing reserves the right to immediately revoke a membership and terminate Challenge participation, without any refund or issuance of Gym Credit, for any violation of the facility's Code of Conduct or safety rules. In such cases, the initial $999.00 CAD pledge will be considered forfeited.
Climbing is an inherently dangerous activity. By purchasing this pass, you acknowledge and voluntarily assume all associated risks on behalf of yourself and/or the Minor Pass Holder. All Pass Holders must have a valid KONG Climbing Liability Waiver on file, signed by themselves or their Guardian.
The Kong Launch Challenge is a limited-time offer. KONG Climbing reserves the right to modify or terminate this offer for new purchases at any time. All decisions by KONG Climbing management regarding the interpretation of these Terms are final and binding.
